MINUTES OF GEORGEHAM PARISH COUNCIL MEETING HELD ON THURSDAY 28TH APRIL 2005 IN GEORGEHAM VILLAGE HALL ON THE RISING OF THE ANNUAL PARISH ASSEMBLY. PRESENT: Councillor J Symonds (Chairman), Councillors Mrs J Barnes, Miss R Brian, W Foster, N Mapp, Mrs V Meek, Mrs L Slade, R Tucker, J Yeo. Also in attendance: 8 members of the public and Mrs S Squire, Parish Clerk. 149. APPROVAL OF THE MINUTES OF THE MEETINGHELD ON 31MARCH 2005. These were approved and signed after it was noted that the DEFRA letter, referred to in Minute 147 on Page 7, was a Bill. The Minutes had stated it was not a Bill. 150. APOLOGIES. County Councillor D Spear, PC G Lees, District Councillors P Evans and M Wilkinson. 151. MATTERS ARISING FROM THE ANNUAL PARISH ASSEMBLY. None. 152. MATTERS RAISED BY MEMBERS OF THE PUBLIC. A resident raised the proposed use of a parcel of land which abuts a property in Moor Lane, adjacent to the footpath for household waste. He outlined the position. A letter to be written to Planning and Environmental Health as it is believed that this would require Planning and Environmental Health control. 153. PLANNING. (1) Matters Arising. (a) Report by Councillor Symonds on Meeting with the Planning Manager. The Planning Manager had been unavailable and efforts would be made to have a meeting before the next meeting. (b) Reply by Enforcement Officer regarding Croyde Manor. He had visited site and advised the pillars have been dismantled, not demolished. They are stored and it is the owners intention to replace when work was completed on the building. (2) Applications, as below: (a) 39770 Ð Erection of dwelling (amendment to planning permission 38801) land adjacent to The Whiteleaf Hotel, Sandy Lane, Croyde. Councillor Tucker proposed approval with the caveat "however concern was raised about the size of the plot and the potential development of the plot", seconded by Councillor Foster. Vote: 8 in favour, 1 against, carried. (b) 39619 Ð Continued siting of summer bungalow (renewal of limited period planning permission 27951) Ð Cockleshell, 4 Leadengate Close, Croyde. It was RESOLVED to recommend approval provided it remains at 10 month occupancy condition. (c) 39794 Ð Application for consent for works to trees covered by a Tree Preservation Order in respect of felling of 8 Cupressus Macropcarpa and 2 Pinus Insignis Ð Moorfield House, Moor Lane, Croyde. Subsequent to this Application being received, deep concerns were raised by Western Power and Devon County Council who considered the trees were dangerous and wished the felling to be brought forward to 20 April. In the circumstances, given the severity of this issue, the Parish Council advised it had not objection to the work being carried out. The chairman advised that the Council approved this. In addition, it would like to see some form of replanting and support Mr A TuckerÕs views on the replanting scheme. He mentioned that the Press had been trying to make contact about this case. Page 2 Ð 28.04.05 d) 39690 Ð Change of use from guest house to dwelling Ð West Winds, Moor Lane, Croyde. It was RESOLVED to recommend approval. e) 39862 Ð Extension to dweling & conversion of loft space to form additional living accommodation Ð Holmlea, Rock Hill, Georgeham. It was RESOLVED to recommend approval with the condition that the colours and building materials are in sympathy with the existing building. f) 39762 Ð Conversion of 2 barns to form 2 units of holiday accommodation Ð North Buckland Farm, North Buckland. It was RESOLVED to recommend approval. g) 39893 Ð Conversion of garden to form childrens play area Ð St. GeorgeÕs House Christian Outdoor Activity Centre, Georgeham. It was RESOLVED to recommend approval with the condition that the Parish Council would expect the owners to carry out a tree planting scheme comprising native deciduous species to replace the trees which would be taken down as a result of the conversion. It would also be expected that the applicants keep the garden wall in good order. In due course, the Parish Council would be looking to submit a Listed Status Application in respect of the garden wall. h) 39771 Ð Erection of two dwellings Ð Plot 4 & 5 Penny Hill, Pathfields, Moor Lane, Croyde. It was RESOLVED to recommend approval. An additional comment to be "We expect the planning department to maintain control over the percentage of local needs housing that will come within the whole development known as Penny Hill". i) 39772 Ð Erection of 1 dwelling Ð Plot 3 Penny Hill, Pathfields, Moor Lane, Croyde. It was RESOLVED to recommend approval. An additional comment to be "We expect the planning department to maintain control over the percentage of local needs housing that will come within the whole development known as Penny Hill". j) 39898/39812 Ð Listed Building Application Ð construction of partially Underground swimming pool complex , Croyde Manor, St MaryÕs Road, Croyde. It was RESOLVED to recommend approval. k) 39936 Ð Outline Application for erection of 1 dwelling Ð Garden of Rose Cottage, North Buckland. It was proposed by Councillor Tucker and seconded by Councillor Miss Brian to recommend refusal on the grounds that it is outside the development boundary. Vote: 7. Carried. (3) Planning Correspondence: (i) The following NDDC Decision Notices were noted: APPROVALS 39306 Ð Erection of 1.52m high wooden fence on southern boundary & installation of satellite dish on chimney (amended plans) at Shipponrill, Millers Brook, Croyde, together with letter from Planning Department explaining why the Application has been approved. 39488 Ð Removal of condition 4 (personal restriction) attached to planning permission 86/2116/28/04, Bay View Farm Caravan & Camping Park Croyde Bay, together with letter from Planning Department explaining why the Application has been approved. 39485 Ð Works to trees in a Conservation Area Ð Chestnut Cottage, 11a St MaryÕs Road, Croyde. Page 3 Ð 28.04.05 39513 Ð First floor extension to dwelling at Bay View Cottage, Hobbs Hill, Croyde. 39540 Ð Extension & alterations to dwelling at 3 Home Farm Close, Croyde and accompanying letter from Planning Unit giving the reasons for the approval. 39479 Ð Retrospective application for formation of hardstanding at entrance to car park at land opposite Down End Car Park, Down End, Croyde. 39646 Ð Application for consent for works to trees covered by a Tree Preservation Order in respect of reduction of height of sycamores at 7 Williamson Close, Georgeham. 39513 Ð First floor extension to dwelling at Bayview Cottage, Hobbs Hill, Croyde. 39651/39607 Ð Listed building application for erection of shed to rear of Skirr Cottage together with installation of 2 rooflights and alterations to rear window of Clare Cottage at Clare and Skirr Cottage, Georgeham. 39480 Ð Erection of double garage & store to replace existing single garage at Wray Cottage, Cross, Croyde. 39645 Ð Conversion of 2 holiday units to form one holiday unit at Pickwell Manor Farm, Georgeham. 39488 Ð Removal of condition 4 (personal restriction) attached to planning permission 86/2116/28/04 at Bayview Farm Caravan & Camping Park, Croyde Bay, Croyde. (ii) Public Entertainment Licence Ð The Thatched Barn Inn, Croyde. A reply was required by 18 April. The Chairman was contacted and apprised of the situation who instructed the Clerk to reply as follows "Provided that there are no material changes to the current licence there are no objections". The following reply has subsequently been received from Environmental Health: "Thank you for your comments, there will be no changes on the licence as it is purely a renewal". (iii) Public Entertainment Licence Renewal Ð Croyde Bay Holiday Village. Monday to Saturday 1000 hours to 0100 hours. Sunday 1800 hours to 2330 hours. There was no material objection to this. When replying mention that the surname was stated as Williams, whereas in fact it is Willis. 154. MATTERS ARISING: (i) Parking Restriction Ð Millers Brook. Mr D Netherway to be contacted regarding the position, following his letter to PC Lees. (ii) NDDC Flood Alleviation Task Force Response (Councillor Foster). He reported that he had walked the length of the stream on 1 April and submitted a report to Mr Wareing of the Engineers Department to ascertain if funding is available from the District Council for clearing it. A reply will be received in May. The District Council continue to look favourably on the flood alleviation scheme and a landowner is also positive about this and is agreeable for his land being used as a wetland area to help the situation further downstream. Councillor Miss Brian raised the fact the there were stones in the stream and was advised that these had been inspected and will be removed by Councillor Foster. (iii) Comment on Licensed Premises Ð Police. A letter containing positive comments had been received and was read to the Meeting. (iv) Playground Inspection in connection with the Disability Discrimination Act. The ROSPA Report had been received, copies of which had been sent to the Chairman and Vice Chairman. Further clarification had not been received from the contact at Devon County Council, despite a reminder, and it was hoped this would be available for the next meeting. A sub committee comprising Councillors Symonds and Tucker was formed to compile work required, with a view to issuing the work before the next Meeting. (v) Repair of Georgeham Noticeboard. The Contractor has been asked to do and will be reminded. (vi) Vehicles parked in Georgeham Car Park. As a result of our email advising the vehicles there, Martin Coles at Environmental Health replied to which the Chairman replied and he had since had dialogue with him. There is very little which can be done as it would not appear that the vehicles are abandoned. The next step was explained which involved Page 4 Ð 28.04.05 writing to DVLC for the ownerÕs name, a letter to him and the threat of Court action. The issue of charging to park was discussed. A separate meeting was arranged for Thursday, 2nd June at 7 p.m. as to how the Parish Council would arrange the car park. (vii) Flooding in St. MaryÕs Road. Councillor Foster reported that the recently formed Steering Group to produce a Village Design Statement had not met. On further investigation it was not felt advantageous and PPG 15 would achieve the objectives we have for the village. (vii) Repair to playing field hedge by Councillors Symonds, Yeo and Mapp. This item was outstanding and would be dealt with on Saturday, 30 April at 11 am. (viii) Replacement of signs at Ford and Heddon Mill. Done. (ix) Replacement litter bins outside Georgeham Village Hall and St. GeorgeÕs Church. NDDC have confirmed that these will be replaced when their new stock arrives. (x) Work to seats at Croyde Bridge and other locations. This will be done shortly. (xi) Up to date position regarding preparation of representation by Councillor Mrs Meek on behalf of the Parish Council regarding the BOATS Inquiry. She has received the County CouncilÕs submission which she would study to ensure all items had been covered in the Parish CouncilÕs representation. (xiii) Georgeham Toilets Ð up to date position regarding Transfer Agreement from NDDC. In addition, a letter has been received from NDDC advising it is necessary for them to establish who is the appropriate person(s) to sign the Agreement. They also wish to know what is specified in Standing Orders. The document had been read by Councillor Symonds but not, as yet, by Councillor Tucker. The document to be passed to our Solicitors for their comments before signing due to this Council not being in agreement with some of the Clauses. The Chairman and Vice Chairman to meet the solicitors. (xiv) Braunton Parish Council. Letter replying to the ChairmanÕs letter regarding Definitive Map Review. 155. CORRESPONDENCE. a) DCC Ð Minerals and Waste Development Frameworks. Letter and accompanying questionnaire for completion by 22 April. Sent to Councillor Foster for attention ahead of this Meeting. He had completed this and returned it. b) North Devon AONB. Details and dates of Partnership Meetings for 2005/06. Taken by Councillor Miss Brian. c) Mr D Tucker Ð Management of the Georgeham Playing Field Trust. The situation was explained to the meeting. Councillors approved that the gate continue to be remain unlocked. To write to NDDC Legal Department for guidance. d) NDDC. The New Licensing Arrangements. We are no longer to be consulted as in the past. The 28 day cycle and sub committee to be formed to comply with 28 day rule. 6 August is closing date for new applications. The onus is on the Parish Council to be aware of the situations. A Sub committee comprising Councillors Miss Brian and Mrs Meek was formed and should any details be noted on the weekly NDDC Bulletin, the Clerk to advise them. e) NDDC. Ethical standards letter. Chairman explained contents so that Councillors were aware that Declaration of Interest was important to be declared. f) Letter from Mr R J Hore again complaining that the dog bins have not been emptied resulting in a bad odour. The letter has been acknowledged and a copy taken for JJ Bins information and action. Councillor Foster had also advised JJ Bins of the problem. The cheque in respect of their most recent Invoice to be withheld pending an improvement in the situation. g) CPRE Ð Posters for display saying the village has been entered in the Best Kept Village in Devon Competition. Councillor Foster had provided a map of the village, and a cheque for the entry fee of £5.00. h) The Trafalgar Weekend. This falls on 21 Ð 23 October 2005 and is the bicentenary of the Battle of Trafalgar. Booklet how to take part. Page 5 Ð 28.04.05 i) DCC. She reported on her attendance of the new licensing laws meeting. A general discussion ensued on licensed premises within the Parish. 158. COUNCILLOR MRS V MEEK Ð PARISH PLAN. Covered earlier in the Meeting. 159. MEETING DATES FOR THE MUNICIPAL YEAR MAY 2005-MAY 2006. The following dates were approved and agreed: 2005: 26 May Annual Parish Meeting, Croyde; 30 June, Georgeham; 28 July, Croyde; 25 August, Georgeham; 29 September, Croyde; 27 October, Georgeham, Tenders awarded; 17 November, Croyde, Budget agreed; 15 December, Georgeham, Precept agreed; 2006: 26 January, Croyde; 23 February, Georgeham; 30 March, Croyde; 27 April, Annual Parish Meeting followed by Parish Council Meeting, Georgeham. 160. GEORGEHAM CAR PARK RULES FOR USE. Meeting on June 2nd previously discussed at this Meeting. Posters to be prepared. 161. MATTERS RAISED BY COUNCILLORS. Councillor Symonds Ð he had been in dialogue with Mr Humphries regarding communication. An article to the put in The Crydda as to how to communicate better with the Council. 162. MEETINGS ATTENDED BY COUNCILLORS. i) Planning Department covered under 6 (v) above. ii) Report of larger Steering Group on 20 April Ð Councillor Mrs Meek. This was not held. iii) Report of Braunton Alliance on 5 April - Councillor Mapp. He advised the outcome of the meeting. It had been chaired by Mr Ian Hobbs, with another Meeting held on 21st April. Mr B Holme did not attend. It focused on funds and this Council was assured there was sufficient money to proceed with the large questionnaires. Consideration would be given to hand delivering some of the questionnaires with others being posted. A further meeting was planned for 8th May when funds would be apportioned, with a further £8,000 to be apportioned. (iv) Councillor Tucker highlighted a litter problem at the Saunton lay-bys which were in the Braunton parish. There was also litter in the fields below the lay-bys and the Tapeley and Saunton Estate, (Mr R Colwill, Trafalgar Lawn, Barnstaple) to be contacted. It was noted that waste bins are not permissible due to hazards of waste collection but arrangements are made for them to be cleaned. 162. FINANCE.
