PRESENT: Councillor J Symonds (Chairman), Councillors Mrs J Barnes, Miss R Brian, W Foster, N Mapp, Mrs V Meek, Mrs L Slade, R Tucker, Also in attendance: County Councillor Derrick Spear, District Councillor P Evans, Sgt A Brock, PC G Lees, 7 members of the public. The Chairman welcomed Sgt Andy Brock to the Meeting, who was the new Seargent based at Braunton Police Station. 127. APPROVAL OF THE MINUTES OF THE MEETING HELD ON 20 JANUARY 2005. These were approved and signed as a correct record. To continue to be sent to the Post Office and not just put on the website. 128. APOLOGIES. District Councillor M Wilkinson at another meeting. Councillor J Yeo. 129. REPORTS: Police. PC Lees reported three accounts of criminal damage since 1 January involving graffiti. In 2004, 120 crimes had been reported which equated to 18% of actual crime reported for Braunton and the surrounding district. There had been 84 between the holiday months of May and September. In comparison with 2003. theft or loss of mobile phones now had to be included in the statistics. Councillor Symonds raised the issue of stickers on almost every sign leading to the Parish of which the Police were aware. Councillor Mapp told the Meeting that the local Beat Manager for Bratton Fleming was starting a new initiative by having a monthly Surgery in the village hall before the Parish Council Meeting. It was agreed that before a similar scheme could possibly be actioned for this Parish, it was important to await the outcome of the Parish Plan which would indicate if parishioners wanted this. District Councillor Evans spoke on a safer North Devon. Sgt Brock introduced himself to everyone and briefly outlined his new role and said he would support a Surgery if our Community Policeman wanted to try it. Councillor Slade to include details in The Crydda. Sgt. Brocks duties include the Community Police Sergeant and the Response Sergeant for Braunton and District. He added they have a Licensing Department if Councillors have any concerns. County Councillor D Spear. He updated the meeting with regard to the Definitive Map Review, BOATS. Councillor Symonds advised that legislation on non mechanically propelled vehicles which is now seen as not the same as mechanically propelled. Parking Restriction at Millers Brook. He advised that provided the due process of consultation is carried out, there should be no trouble in implementing this. DCC had set their budget at 3.5% and had made genuine efficiency savings. Safety Outside Georgeham Post Office. He would continue to press for this and was currently looking for other ways for this to be implemented. District Councillors P Evans. He advised about BOATS and reiterated what County Councillor Spear he said. He introduced Jasmine Chesters, the prospective candidate for the forthcoming County Council Election on 5 May 2005, and Jenny Jenkins, who was also standing for County Council. He raised the issue of Brownfield sites. Licensing responsibilities would be assumed by NDDC from 7 February. He mentioned the recent Planning Committee Meeting and the granting of planning approval in respect of the two metal containers on the Playing Field, following Councillor Tuckers speech to the Committee. Page 2 2.02.05 Councillor Foster enquired the position on District Council funding for lifeguards and was told that beach owners would be responsible for this. Councillor Tucker explained the situation at Putsborough for the benefit of the Meeting. 130. REPRESENTATIONS FROM THE PUBLIC. On behalf of Mrs R Cross of Georgeham Post Office regarding the display of Minutes and Agendas at the Post Office. She confirmed that the Minutes and Agendas were displayed and was assured that this information would be relayed at the meeting. After speaking with the Chairman, the Clerk was authorised to send the papers for each meeting in future to him for the Croyde Noticeboard and to Councillor Mrs V Meek for the Georgeham Village Hall Noticeboard and Shop. Councillor Symonds advised that he was of the opinion that papers should be displayed but confirmed that it was at the discretion of the Postmaster, although the Postmasters Training Department felt it was an ideal way of communicating to the public. Mr R Holmes on behalf of Georgeham Football Club expressed thanks for the Parish Councils efforts in getting the temporary facilities approved at the Playing Field. 131. PLANNING: (1) Matters Arising. NTL Transmitting Station, Croyde. Councillor Mapp produced a report following his analysis of the reply which was in order. He confirmed that there was nothing high powered or beamed constantly or to the ground and all health and safety requirements had been addressed. Reply from the Enforcement Officer regarding Croyde Baptist Church Car Park who advised that it would appear the car park has been extended onto agricultural land which could mean a change of use of land as well as a development. He has more research to complete but at present he is on the opinion that the works require planning permission. If this is the case, the parish council will have to await the planning application when it would then be considered. c) Planning Application for two metal containers at the Playing Field. Councillor Tucker advised that he and Councillor Mapp had attended the Planning Committee Meeting on 16 February 2005 which considered the application. Councillor Tucker had spoken on behalf of the Parish Council and in support of the temporary siting of the two metal containers. The Planning Committee had granted approval for two years. He was thanked for his attendance, together with Councillor Mapp, and for all the effort and hard work he had put in to help obtain a successful outcome. A letter of thanks to be sent to Mr T Richards. Results of the Parish Plan Meeting will gauge public opinion for a permanent structure on site. If this was favourable, the help of colleagues at Braunton to be enlisted, together with District Councillor Morrish who was experienced in this field. It was noted that Councillors were attending fund raising courses. Applications, as below: i) 38954 Reserved Matters Application for erection of 1 dwelling with detached garage (Outline Planning Permission 32400) (amended plans) Plot 2, Penny Hill, Croyde. It was RESOLVED to recommend approval. ii) 39302/39303 Listed Building Application for erection of pool house together with erection of corridor between house & pool complex & alterations to existing outbuildings Croyde Manor, St Marys Road, Croyde. A site meeting was arranged for Monday 28 February at 4.30pm. iii) 39270 Continued siting of holiday bungalow (renewal of planning permission 28285) Innisfree, 17 Leadengate Close, Croyde. It was RESOLVED to recommend approval. Page 3 24.02.05 (iv) 38173 Outline Application for residential development, land off Lane Head Close, Moor Lane, Croyde. It was noted that the Council originally commented on 23/9/04. As a result of this, additional information from the applicants Agent has been received and the Parish Council had been invited to make additional comments, which were as follows: The Parish Councils position on this application remains much the same as it did in September 2004. However, we would expect to see policy upheld regarding the percentage of local needs housing that comes forward with this whole development and understand at the moment that the 4 units offered do not satisfy this percentage. We would also expect any forthcoming 106 agreement to tie the local needs housing in this development at Croyde to the local needs of this parish via a 106 agreement that would reflect the agreement entered into at the development of the Glebefield at Georgeham. (v) 39399 Listed Building Application in respect of installation of solar water heating collectors Gibbs, North Buckland, Braunton. It was RESOLVED to recommend approval. (vi) 38609 Notification of Works to Trees in a Conservation Area in respect of reduction of longer branches of common pear Post Office, St. Marys Road, Croyde. It was RESOLVED to recommend approval. (vii) 39350 Extension to dwelling (amendment to planning permission 38539) Kennelfield, Georgeham. It was RESOLVED to recommend approval. (viii) 39455 Removal of condition 2 (occupancy restriction) attached to Planning Permission 10864 Higher Roylands, Moor Lane, Croyde. The applicant was permitted to address the meeting. It was proposed by Councillor Mrs Slade to recommend approval. Seconded by Councillor Mrs Barnes. Councillor Tucker tabled an amendment, namely - the Parish council is aware of the circumstances regarding the application, and the unique circumstances attached to it we feel therefore there may be room to set aside policy and let the condition 2 as stated in 10864 be lifted. Seconded by Councillor Mrs Slade who withdrew her original proposal. (ix) 39464 Extension to dwelling Thornberry, Stentaway Lane, Croyde. It was RESOLVED to recommend approval. (x) 39306 Erection of 1.52m high wooden fence on Southern boundary & installation of satellite dish on chimney Shipponrill, Millers Brook, Croyde. It was proposed by Councillor Tucker to recommend approval and seconded by Councillor Symonds. Councillor Miss Brian tabled an amendment to recommend refusal due to the fact that this was in a Conservation Area. Seconded by Councillor Mrs Meek. Vote: for approval 3, vote against 4. 1 abstention. The amendment was carried refusing the application due to being in a conservation area. (xi) 39480 Erection of double garage & store to replace existing single garage Wray Cottage, Cross, Croyde. It was RESOLVED to recommend approval subject to the garage remaining as such and not as accommodation. (xii) 39488 Removal of condition 4 (personal restriction) attached to Planning Permission 86/2116/28/04 Bay View Farm Caravan & Camping Park, Croyde Bay, Croyde. Representatives were allowed to address the meeting. It was proposed by Councillor Tucker to recommend refusal, seconded by Councillor Miss Brian. Councillor Symonds tabled an amendment to recommend approval, seconded by Councillor Mrs Slade. Vote: 6 to refuse on the grounds that it does not Page 4 24.02.05 detract from running of business and that the condition should remain as above. Approve 2. The original proposal was carried. (xii) 39485 Notification of works to trees in a Conservation Area in respect of removal of overhanging branches and reduce tree height to 6 metres tall to 3 oaks Chestnut Cottage, 11a St Marys Road, Croyde. It was RESOLVED to recommend approval. (xiii) 39513 - First Floor Extension to dwelling Bayview Cottage, Hobbs Hill, Croyde. It was RESOLVED to recommend approval. (xv) 39406/7 Listed Building Application for conversion of first floor of outbuilding to form playroom Speedwell, Georgeham. It was RESOLVED to recommend refusal as our original approval for this building was to be developed for storage only. (The Application Numbers to be applied). To take this development into further domestic use would go strongly against the wishes of this Parish Council. (xvi) 39277 Installation of 2 dormer windows Moor Park, Moor Lane, Croyde. It was RESOLVED to recommend approval. (xvii) 39540 3 Home Farm Road. This to be considered at a later Meeting. This was read. 39246 Removal of condition attached to planning permission 32183 to extend occupancy period to 10 months at Sea Breeze, 15 Leadengate Close, Croyde. REFUSALS. 39176 Siting of 3 freestanding signs at Croyde Bay Holiday Centre, Croyde. 38964 Prior approval application for erection of timber storage building at OS 6940 Field, Withywell, Croyde. This was read. THE FOLLOWING DETAILS FROM THE PLANNING INSPECTORATE WERE NOTED: Confirmation has been received that the BOATS Inquiry will be held on 10/5/05 in Croyde Village Hall. Page 5 24.02.05 CORRESPONDENCE FROM THE ENFORCEMENT OFFICER REGARDING KITTIWELL WAS NOTED. AN APPLICATION FOR THE RENEWAL OF A PERMIT FOR THE PROVISION OF AMUSEMENT WITH PRIZES was considered at Croyde Bay Holiday Village (Unison), Croyde Bay, Croyde. Councillors approved the renewal of the Licence. 132. MATTERS ARISING: Parking Restriction Millers Brook. Copy correspondence from Devon County Council to PCG Lees dated 19/1/05. This was noted and it was encouraging that Devon County Council considered that PC Lees suggestion for yellow lines could be usefully added to their list for future Traffic Regulation changes, which would take some months to progress. This issue should be revived at alternate meetings. A letter has been sent to Mr Parker. Work to tree Davids Hill. Following correspondence and telephone conversations between Councillor Mapp and the Clerk, an email had been received advising that the work will be done by 2nd March. Copy correspondence regarding flooding from DCC to Mr D Tebbutt dated 21/1/05. This was noted and there was a discussion about the stream at Croyde. Vehicles parked in Georgeham Car Park. Environmental Health had advised that they had received a letter from the registered keeper of the vehicle thought to be abandoned who lives next to the car park. He advised that the vehicle is not abandoned but awaiting repair. It was anticipated that it would be moved by the end of the month. In view of this, Environmental Health would not be taking any further action. A copy of the letter to be requested from Environmental Health in order that the owner/keeper of the vehicle can be contacted. Georgeham Noticeboard. Councillor Tucker will engage a carpenter to repair it. Maps for Parish Plan meetings. Following a request for these from the Parish Plan Committee, the Clerk had made extensive enquiries. The Chairman had authorised her to place an order for 6 x 1:10,000 scale maps at a price of approximately 7.00 each and these were awaited. Four more footpath maps had also been requested. Drains/Gullies in Chapel Street. Following the last meeting, Councillor Mrs Meek had seen some workmen in Chapel Street who investigated the drains. It was confirmed they did not have a sump facility and due to the fact that they were blocked solid, a heavy duty machine would be required. This was being organised. They will be notified of any problems. North Devon Areas of Outstanding Natural Beauty. Following the Teams presentation, letter received in respect of follow up to the discussion. This was generally regarded as unhelpful. They would be resisting the BOATs order. Copy correspondence from DCC to Mrs R Cross regarding Footpath Provision, Georgeham Post Office. Noted and covered under County Councillor Spears Report earlier in the meeting. Letter of thanks from Mrs S Oldham to the Parish Council and Clerk regarding the new road surface between Croyde and Forda. Noted. Letter from Georgeham Football Club regarding problems with footballs going into neighbouring gardens. The letter also included confirmation that the Club will be Page 6 24.02.05 responsible for paying utility charges. A letter had also been sent to St. Georges House, no reply had been received. l) NDDC. Previously developed land and buildings in North Devon. They requested details of possible site for development. For further consideration by Councillors Symonds, foster, Tucker and Mrs Slade, who would receive a copy of the letter each. 133. An update on the balance was given which stood at 1,089.15. All Councillor were automatically Trustees while Councillors. An update on the balance was given which stood at 13,446.45. Updated signatories to be Mrs S Squire, Councillors Symonds, Tucker, Mrs Meek and Foster. d) Tenders: (1) The Tender for grass cutting at the Playing Field and Cemetery submitted by Mr S M Wightman for a total of 4,680.00 + VAT was accepted and approved by Councillors. The Clerk to write to the contractor advising that the contract had been awarded to him for one year. (2) Tender for grass cutting in other areas of the Parish. Two Tender documents had been sent out and terms advertised in The Crydda. One tender had been received. The Chairman declared an interest, left the room and took no further part in the discussion to decision. The contract was awarded to Mr Michael Symonds and the Clerk to advise him accordingly. He felt that an interested leader for the Sports pavilion project should be identified although a group within the Parish Council could progress it. Car park matters being dealt with, Chapel Street overhanging branches have been cut, Davids Hill tree being cut on 2 March. Councillor Foster. Enquired if NDDC had replied to our letter regarding bright colours in a Conservation Area but this was still awaited. The bench on Croyde Bridge awaited attention. The time switch for car park lights to be amended when the clocks alter. Councillor Slade. The pillars at the entrance of Croyde Manor have gone and an appropriate letter to be sent to the Planning Unit. Councillor Tucker. As a safety issue, the Playing Field gate is to be kept locked. Attended the Flood Alleviation meeting at the Civic Centre. Regarding the flood on 18/19 December 2004, a check to be made to ensure that debris does not build up in future. Consideration to be given to tree planting and reed beds between Croyde and Cross. Funding may be available. Landowners were positive. To be an April Agenda item. Work had been carried out on the trees at Joness Hill which had been well done. Councillor Meek. Flyers will be posted with regard to the Parish Plan Meetings.
