MINUTES OF GEORGEHAM PARISH COUNCILMEETING HELD ON MONDAY, 20 NOVEMBER 2006 AT 7 P.M. IN GEORGEHAM VILLAGE HALL. PRESENT: Councillor J Symonds (Chairman), Councillors Miss R Brian, N Mapp, S Maskell, Mrs V Meek, Councillor Mrs L Slade during Minute No. 94, R Tucker. Also in attendance: 1 member of the public and Mrs S Squire, Parish Clerk. Councillor Mapp advised the Meeting that former District Councillor Phil Evans had passed away while on holiday in Madeira the previous day. 89. APOLOGIES. Councillor M Harrison. 90. REPRESENTATIONS FROM THE PUBLIC. Nothing raised. 91. BILLY BUDDS/THATCHED BARN APPEAL. Councillor Maskell had previously proposed that arrangement were put in place where members of the public could report incidents of inappropriate behaviour or drinking outside which could then be logged as a Parish Council issue which if necessary could be taken further with North Devon District Council or the Police. It was noted that the Police had previously advised that they had never received any complaints of this nature but it was known that incidents had taken place. In addition, it was known that complaints had been made and Councillor Maskell questioned where these had been logged. Councillor Tucker was concerned that the Parish Council should not appear as if there was victimisation and this was noted. It was however important that any incidents are reported to the Police as otherwise they will never be logged. Councillor Mapp advised that a log number is given when an incident is reported to the Police and Councillor Mrs Meek advised that if the Parish Council were told this would be secondary evidence when we reported it and this is less useful at Appeals. The person making the complaint must be told they should tell the Police. Councillor Mrs Meek further advised that licencees are only responsible for what happens inside their pub and if there is an issue outside no responsibility rests with them but the Police then become involved. Camper van parking in lay bys was also discussed and also that the Police searched local public houses on Friday evening. Councillor Maskell to liase with Councillor Mrs Slade to draft an article to go in the January edition of The Crydda. Councillor Mrs Meek showed control order about banning drink in centre of Barnstaple and the possibility of including Croyde and passed a copy to Councillor Symonds. 92. LLOYDS TSB BANK ACCOUNT. Members unanimously agreed that a 30 day Notice Account which pays interest be opened. The Clerk to enquire if all present signatoriesÕ details are required. 93. TENDER WORDING. For audit purposes, it was noted that Mr S WightmanÕs figures per cut at the Cemetery was £68.72. As regards Grass Cutting and General Maintenance two local contractors to be asked to tender for Croyde Play Park, Davids Hill, Georgeham Car Park and Village Green area (flower borders) and Putsborough Close. 94. PARISH PLAN IMPLEMENTATION PROPOSALS. Councillors had previously been circulated with the list of details and Councillor Mrs Meek explained and went through this. The following items were highlighted: _ Georgeham Sports Association. Councillor Maskell (who was also linked to the Skateboard Club) will attend the Meetings when possible, otherwise Members would attend on a rolling delegate basis. _ Croyde Surf Life Saving Club. Their plans were in the very early stages with a possible boost in April 2007. Councillor Mapp pointed out that this Parish had carried out a Parish Plan and as a result, an Action Plan had been formed. The major items which people had indicated they would like to see had been prioritised. This was the major point of doing the Action Plan and for interested people to form Committees and apply for funding. The committees had each received an information pack and had been given the opportunity of attending training courses. In January a course would be run by the Community Development Unit at a central venue with experienced representatives from various projects advising how and where to apply for various grants and how to prepare a business plan. He went on to say that one of the important items is to generate income to meet their projects running costs. Councillor Maskell advised that the skateboard project is very advanced with most of the money required accounted for and he expected that they would shortly be asking for a venue for this. A possible location was the beach volley ball court and in this connection, Denise Austen to be invited to the January Meeting to give an update on the present condition. _ Councillor Symonds was on Croyde Village Hall Committee; Councillor Mrs Barnes was on Georgeham Village Hall Commiiittee and Councillor Mrs Meek and Councillor Mapp liase with both Halls. Councillor Mrs Meek expressed thanks for help at the Northern Devon Rural Alliance Meeting on 6 November. _ The Sports Pavilion project still only had representatives from the Football Club and unless this is addressed, it would weaken their case. Councillor Mapp had suggested to them that they put an article in The Crydda asking for people to come forward to incorporate other elements and to inform the parish for their outline plans for the future. _ Wayside rubbish. Refuse frequency collection is in hand but no further details were known. It was felt that collections should go over to Saturdays due to second homes/holiday lets. It was noted that Greensweep had sent a questionnaire for residents to complete that day and this would be attended to. _ Footpath from Croyde. This had been minuted and was in order. _ Traffic Danger Spots. The Clerk to ask Mr Joe Deasey to meet Councillors to look at those areas highlighted in the Parish Plan documents. _ School. It was noted that we did not have any links with the Primary School and a letter to be written to Mr R Cross, Chairman of the Governors on this subject. _ The Parish would be involved via The Crydda magazine. A Whats On list was requested within the Parish Plan but this was felt to be impractical. _ Noticeboards. Done. _ Councillor Mrs Meek has a copy of a letter from a County Councillor and she will draft an interim formal report in reply. _ Oceanfest. In hand. _ The next Meeting of the Parish Plan was to be held in January, this has been altered to February together with a meeting of the original Parish Plan Committee to look at medium term things and to identify if other items could go forward. 95. CHAIRMANÕS BUSINESS. ROCKets Grant. Councillor Symonds to obtain an invoice from RSS Playmakers so that Councillor Miss Brian can progress this. CARA. A letter of thanks to be sent for an excellent job of clearing the stream. 96. GEORGEHAM TOILETS. Councillor Symonds reported these had been vandalised and subsequently cleaned and repaired. They are now locked after the last bus. A token of the Parish CouncilÕs appreciation to Mr D Tucker to be obtained for Christmas. 97. DECEMBER MEETING. The School required the Village Hall, so the Meeting on 14th will be held in the School. 98. FOOTPATHS. It was advised that if we are to maintain P3 funding, a project will need to be identified and last yearÕs grant would have to be spent and details shown on the Survey forms due to be submitted by February 2007. 99. BUDGET. Councillor Symonds and Councillor Mrs Slade had met at the ClerkÕs home and prepared budgetary figures which were circulated to Councillors. It was proposed by Councillor Tucker, seconded by Councillor Maskell and unanimously agreed to accept the Budget. 100. OTHER MATTERS. Councillor Mrs Meek advised that in connection with Footpath 6/18, she had informed the Rights of Way Officer that gates had been fixed on the Bridleway and they were investigating. The suggestion was to put high handles on gates so they can be opened by horse riders while sitting astride their horse. PRESENT: Councillor J Symonds (Chairman), Councillor Mrs J Barnes, Miss R Brian, N Mapp, S Maskell, Mrs V Meek, Mrs L Slade, R Tucker. Also present: District Councillors D Spear and M Wilkinson, PC Russ Fisher, Richard Peacock PCSO, 3 members of the public and Mrs S Squire, Parish Clerk. 101. APOLOGIES. County Councillor Mrs J Jenkins; Councillor M Harrison 102. APPROVAL OF THE MINUTES OF THE MEETINGS HELD ON 26 OCTOBER, 27 OCTOBER AND 20 NOVEMBER 2006. These were approved and signed as a correct record. 103. REPORTS. Police Ð PC Russ Fisher introduced PCSO Richard Peacock who commences his duties on 2 January 2007 and was undergoing training at present. As regards crime, it had been a quiet month with 1 reported crime in Croyde involving theft of mobile phone, 1 assault at Georgeham involving a school boy by another school boy and a stolen caravan from Heddon Mill which was well secured. There had been a minor fight/disturbance at Ruda but no complaints or arrests. The Police carried out a drugs operation at Braunton and 3 pubs in Croyde village. 5 Community Service Officers were present to observe. No arrests were made in this connection, with one arrest of one person in breach of bail conditions. Councillor Maskell asked if it was considered the best time of year to carry out this type of operation and was advised that these types of exercises were planned when manpower allowed. There were plans to do repeat the operation in the summer. As regards last monthÕs crime, there were a few incidents at Ruda. Regarding the burglary at Darracott this was considered is no longer a crime but a domestic situation where items had been taken. Councillor Symonds raised the by law which had lapsed in Croyde and was being replaced with a Control Order. He asked if it was strong enough to enable the Police to carry on to the best of their ability preventing drinking in public in the heart of the village. PC Fisher to investigate and get back to us. District Councillor Spear advised that the normal processes were being carried out. This issue had been to full Committee and was currently with the Overview and Scrutiny committee and both District Councillors were asked to investigate this and support the Parish Council. District Councillor D Spear. He spoke about the Planning Department and delays which had occurred. New staff had been appointed and it was hoped would have an impact. As we pay the highest water rates, he was pleased to see that sea water standards at Croyde Bay, Putsborough and Woolacombe were classified as excellent. The viewing bays at Saunton Sands are supposed to be cleaned 3 times a week. It was noted that the lay bys often have cars in them making them difficult to clean. He will continue to pursue. Councillor Miss Brian informed the meeting that as previously arranged, she contacted Braunton Parish Council who advised that they are cleaned early in the morning, several times a week with a workman to pick up the litter and one to stay in the van. The Police are making a campaign about litter and District Councillor Spear has taken the opportunity to speak to them about it. He felt that the Northern Devon Area Committee Meeting chaired by District Councillor Wilkinson was excellent. Questionnaires are going out to the community asking for opinions. District Councillor Wilkinson. He raised the meeting of the Northern Devon Rural Area Committee and thanked Councillors for arranging excellent hospitality and presentations. Members of the Committee were most impressed with the evening on 6 November. Grants for some projects would be easier to obtain than others and the one which came to the fore was Sports Pavilion project and difficulties may be encountered for funding. Recycling Manager David Rogers was present and spoke of three main thrusts: an audit through recyclying services of commercial establishments (NDDC is not in charge of them), secondly since recycling pavilions had been removed, if there is justified need within any Parish, an application can now be made for bottle and paper recycling banks similar to those seen at Tesco and the contact is David Rogers The recycling pavilions across the County were not proving not viable, but in certain villages these had been used well; thirdly Ð the use of green wheelie bins for composting waste when many rural gardens have a compost heap. There seemed little merit in taking the waste for recycling in Barnstaple when this is being carried out adequately within the Parish. Ward members will contact NDDC to enquire if green bins are viable in rural areas. Councillor Symonds raised the collection day of the bins following complaints received that bins are left out all the time particularly on the street and at holiday lets. The collection day for Croyde, Mortehoe and Woolacombe should have a Saturday collection to coincide with changeover day. He also felt there should be a reminder to people to take bins in. Councillor Mrs Slade felt that holiday lets should pay commercial rates. Details of collections over Christmas were in the North Devon Journal The Full Council had stood for a minuteÕs silence in memory of the late Phil Evans, a former District Councillor. His wife was now at home but no funeral arrangements were available. Georgeham Playing Field. Trevor Richards, agent for the Football Club and the Parish Council advised that the Planning Application for the Sports Pavilion had been submitted. The Planning Officer had requested levels which he is attending to. A report from Robert Crabb noted it was the best presentation he had ever had. £10,000 had been ringfenced and other money was coming from a developer. A gift of £5,000 had been received. 104. REPRESENTATIONS FROM THE PUBLIC. None. 105. DECLARATIONS OF INTEREST. Councillor R Tucker declared a prejudicial interest in respect of Planning Application 43170 (2 f) and 3 Ð Certificate of Lawfulness. Councillor S Maskell declared an interest although non prejudicial in respect of Planning Application 43302 (2j) in that it was in the same road as his dwelling. 106. PLANNING. (1) Matters Arising. Enforcement Officer, NDDC. He had replied confirming that no breach of planning regulations had taken place at Mountain Ash Cottages, St. MaryÕs Road, Croyde. (2) The following Planning Applications were considered: (a) 43202 Ð Erection of new entrance canopy to existing main centre building together with erection of sliding folding glazed screen & formation of raised deck Level Ð Ruda Holiday Park, Croyde. It was proposed by Councillor Mapp, seconded by Councillor Mapp to recommend approval. Unanimously agreed. (b) 43189 Ð Extensions to dwelling Ð Woody End, Bottoms Lane, Darracott, Georgeham. Members were in agreement that the applicantsÕ agent who was present was able to comment on the plans to aid Councillors reach a decision. Councillor Tucker proposed a site visit. Seconded by Councillor Miss Brian. Councillor Maskell proposed approval, seconded by Councillor Mrs Slade. Vote: Councillor MaskellÕs proposal -3. Councillor TuckerÕs proposal for a Site visit: 5. Carried. This was arranged for Monday, 27 November at 8.30 a.m. (c) 42064 Ð Listed Building Application for replacement roof to kitchen Ð Rock Haven, Rock Hill, Georgeham. It was proposed by Councillor Tucker, seconded by Councillor Mrs Slade and all agreed to recommend approval. (d) 43232 Ð Erection of two dwellings, access & footpath Ð Garden of Greystones, Croyde. It was proposed by Councillor Tucker, seconded by Councillor Miss Brian and unanimously agreed to recommend refusal and the wording to be as follows: Georgeham Parish Council wish to recommend refusal on the grounds that it is saturation/over development; the proposals offer little or no garden space at all; we consider that they are detrimental to neighbouring properties and not acceptable in this sensitive area of AONB. The proposals offers no effective vehicle turning area on site, finally this proposal offers no affordable housing provision within its context. (e) 43175 Ð Extension to dwelling Ð 4 Home Farm Close, Croyde. Councillor Tucker proposed recommend approval. Seconded by Councillor Mrs Slade. All agreed. (f) 43170 Ð Extension to dwelling & conversion of garage to form additional living accommodation Ð The Garden Cottage, Putsborough. Councillor Tucker having previously declared an interest, left the room, did not take part in the discussion or decision thereof. Mr Trevor Richards spoke on behalf of the applicant. Councillor Miss Brian proposed recommend refusal, seconded by Councillor Mrs Meek. Vote: 5 in favour with 2 abstentions. The following reply to be sent: Georgeham Parish Council recommend refusal on the grounds that the development is out of context in the hamlet of Putsborough. The proposal is surrounded by Grade I buildings and as such, we feel this is not acceptable. (g) 43279 Ð Extension to dwelling Ð Gardeners Cottage, Pickwell, Georgeham. Councillor Mapp proposed recommend approval, seconded by Councillor Tucker and all agreed, provided materials are as per the existing house. (h) 43262 Ð Notification of works to trees in a Conservation area in respect of works to various trees Ð St. GeorgeÕs House, Georgeham. All Councillors were in agreement to recommend approval. (i) 43294 Ð Conversion of garage to form additional living accommodation Ð 9 Home Farm Close, Croyde. Councillor Symonds proposed refusal on the grounds that this house was approved and built recently enough for all to know that without a garage in its original form it would not have been approved, furthermore it is our opinion that far too many garages are being taken into accommodation use and exacerbating on street parking which causes further problems in Croyde. Agreed. (j) 43302 Ð Conversion of loft space to form additional living accommodation Ð 5 Pathfields, Croyde. Councillor Maskell had previously declared a non prejudicial interest, remained in the room and explained the situation of the plans. Councillor Miss Brian proposed refusal, seconded by Councillor Tucker. Councillor Maskell abstained and the remaining Members were all agreed on the grounds that it is over development of an original 3 bedroom bungalow,(which apparently now shows 4 bedrooms behind a garage door!), and furthermore the design is totally at odds with all the rest of the bungalows in this road and parking is not available. Futhermore, if this does progress to become a 6 bedroom bungalow this proposal shows no parking provision whatsoever. (k) 43300 Ð Extension to dwelling Ð 3 Ora Close, Croyde. It was proposed by Councillor Mapp, seconded by Councillor Mrs Slade and unanimously agreed to recommend approval. (l) 43204 Ð Variation of condition 3 (painted timber window and door frames) and Condition 2 (approved plans) attached to Planning Permission 41384 to allow UPVC window and door frames and amended plans Ð land between Sandbourne and Baggy View, Down End, Croyde. Councillor Maskell proposed refusal, seconded by Councillor Miss Brian and unanimously agreed with the following comments: We deliberated long and hard over the original proposal, we found that proposal acceptable partially because it showed traditional timber painted windows. This they now propose to change to pvc, also we are dismayed to see that the changes include more doors that were not incorporated on the original building which we find unacceptable. (m) 43276 Ð Change of use of Tea Rooms to form additional living accommodation Ð May Cottage Tea Rooms, 7 St. MaryÕs Road, Croyde. Councillor Symonds proposed refusal seconded by Councillor Mrs Slade Carried. Additional wording to be: It is detrimental to the centre of Croyde with significant loss of amenity to the holiday village of Croyde, especially with its historical significance, i.e. what is left for the older generation of visitors to Croyde village? (n) 43331 Ð Listed Building Application for replacement window & chimney-pot Ð Burrows Farm West, Croyde. Members unanimously agreed to recommend approval. (3) Application for a Certificate of Lawfulness for an existing use in relation to use of land for the storage of caravans Ð Land at Manor Farm, Putsborough. Legal Services Department had requested any information the Parish Council may have in respect of this Application and which it is felt may assist in the Local authorityÕs determination. Councillor Tucker left the room and did not take part in the discussion or decision. To reply: As far as we are aware, the applicantÕs statements are true. (4) Planning Correspondence: PLANNING ITEMS FOR INFORMATION ONLY. The following NDDC Decision Notices were noted. APPROVALS Ð 42804. Erection of garage and games room (amended plans), Down End House, Down End, Croyde. A letter from NDDC Planning Department has also been received explaining the reason for the approval, noting that the Parish Council had recommended refusal and the letter was read to the Meeting. Retrospective Application for change of use of 1 agricultural building to form shower/toilet block for caravan site at Manor Farm, Putsborough. It was noted that a Certificate of Lawfulness in respect of sub-division of dwelling to form 2 dwellings, erection of garage, sheds and greenhouse and siting of 1 caravan at Fairleigh, Georgeham had been approved and the Certificate granted. Speedwell. Correspondence to the Enforcement Officer regarding usage of outbuildings and his report will follow. 107. MATTERS ARISING. (a) Additional Sewage Storage. Letter received from Black & Veatch (formerly Gleesons) confirming that work will commence at the Lime Kiln Field on either the week commencing 13 or 20 November. It was anticipated that the construction phase will be completed by the end of January 2007 with reinstatement taking place during February 2007. Mr Beaman had not written to Councillor Miss Brian so it had not been possible to draft the letter. (b) Safety Along the Georgeham/Croyde Road. Joe Deasey had replied to our representations on behalf of the parent who had concerns when walking her children to and from School. DCC are unable to make changes unless there are overriding safety concerns evidenced by casualties. There are many of this type of road which exist on the network and to implement consistently would deter from the effectiveness of existing limits and also be extremely difficult to enforce. He wishes however to offer some support to the parishioner and her children and has contacted Ray Pattenden, the School Travel Plan Advisor to explore potential options with Georgeham Primary School. Ray Pattenden advised that the School completed a School Travel Plan in March 2006 but it was very difficult to help because of the restrictions of the site. He was seeing Mike Newcombe the Road Safety Officer that week and would raise our concerns with him and discuss what could be done to try and improve the situation. 108. MOTIONS AND BUSINESS PREVIOUSLY NOTIFIED TO THE CLERK. Website. The Clerk advised that this was in the process of being totally updated by Mr T Squire. Higher Ham Cemetery. Mr Squire was also arranging for revised Cemetery Terms and Condition leaflets to be printed, revised laminated Plot Plans and Questionnaires for Funeral Directors to complete when they have an interment so that all required details are provided to the Parish Council for their records. Parish Plan. Councillors agreed that a copy should be included on the website. Notice of Meetings. White Paper Special. _ South West Coast Path News. Autumn 2006 Issue 14. 113. MEETINGS ATTENDED BY COUNCILLORS. Councillor Tucker. Councillors Symonds, Maskell and Tucker to meet Mr C Burrows regarding the skateboard project to take this forward and a report would follow at the January Meeting. He advised that the preferred easiest and cheapest option is to site this behind Croyde Village Hall where surface works would be minimal and the cost would be approximately one third less. Councillor Mapp proposed that the Parish Council pay the insurance as we are not being asked to support it financially although money had been earmarked. He advised that in the Parish Plan procedures, the skateboarders came out the highest of all. Councillor Mapp considered it was important for the rest of the Parish to be aware that we are supporting this project. He spoken to Mr Tuey in connection with the Volley Ball Court and a meeting was to be arranged and a report would follow at the January Meeting. It was agreed to send a letter of congratulations to Mr Philip Milton following his recent nomination as the prospective parliamentary candidate for North Devon. Councillor Tucker to draft this. Councillor Maskell Ð Playing Field. They now have their own headed paper and are a Registered Charity known as Georgeham and Croyde Community Amateur Sports Club. A donation of £5,000 has been received from Gavin Davis and they are looking forward to the £2,000 which the Parish Council has pledged. This would be available at the December Meeting when it would be handed to a representative from the Club. Other funding was available and awaited. A quotation for the MUGA (Multi Use Games Area) had been received and a decision now had to be taken as to the size of this. He would attend the meetings as often as possible, otherwise other Councillors would attend. Councillor Mapp Ð Local Government Reform Workshop. The workshop was held at Exminster on 22 Nov immediately after the publishing of the Paper. It was noted that the proposals will not be enacted before the end of 2008, that some members of the Cabinet are lukewarm in their support and all is dependant on the Lyon's Report into the funding of Local government .The Report is due to be published in February but there are indications that it may never be published. Councillor MaskellÕs draft letter for The Crydda regarding parishioners concerns (licensed premises, on street parking etc.) and the best way for their concerns to be voiced, heard, logged and acted upon. The letter was agreed and is to be from the entire Parish Council and its intent is to fuel open debate and most importantly to encourage parishioners to attend Parish Council meetings. (i) Application 43189 Ð Extensions to dwelling Ð Woody End, Bottoms Lane, Darracott, Georgeham. Councillors were in unanimous agreement to reply as follows: "Georgeham Parish Council move to refuse. It was felt that the proposal is too big for the site and certainly too high. The height of the proposed building would be detrimental to the visual status of this part of the Darracott hamlet. Council is aware that when "Woody End" was first built it was allowed under an agricultural tie (has this tie been lifted?). It is now split off from the land and outbuildings it had the tie to. Finally, should this development be allowed it would see the loss of a potential "first time buyer" property which this community can ill afford". (ii) Application 43231 Ð Demolition of shed & erection of summer house Ð Down End House, Down End, Croyde. Councillors were in unanimous agreement to recommend approval. The Meeting ended at 9.15 a.m.
